नई दिल्ली। महाराष्ट्र में एक साल से चल रही राजनीतिक उठापठक आज थम गई। एकनाथ शिंदे मुख्यमंत्री बने रहेंगे। सुप्रीम कोर्ट ने गुरुवार को कहा कि उद्धव ठाकरे ने फ्लोर टेस्ट का सामना नहीं किया। उन्होंने स्वेच्छा से इस्तीफा दिया था। ऐसे में कोर्ट इस्तीफा को रद्द तो नहीं कर सकता है। हम पुरानी सरकार को बहाल नहीं कर सकते हैं।
सुप्रीम कोर्ट ने राज्यपाल के फ्लोर टेस्ट को गलत भी ठहराया। अब स्पीकर को शिवसेना के 16 बागी विधायकों पर जल्द फैसला करना चाहिए।
सुप्रीम कोर्ट की बड़ी बातें
सुप्रीम कोर्ट ने कहा कि वह शिंदे और 15 अन्य विधायकों को पिछले साल जून में तत्कालीन मुख्यमंत्री उद्धव ठाकरे के खिलाफ बगावत करने के लिए अयोग्य नहीं ठहरा सकता है। यह अधिकार स्पीकर के पास तब तक रहेगा, जब तक कि सुप्रीम कोर्ट की बड़ी बेंच इस फैसला नहीं सुना देती।
फ्लोर टेस्ट को किसी पार्टी के आंतरिक विवाद को सुलझाने के लिए इस्तेमाल नहीं कर सकते।
राज्यपाल भगत सिंह कोश्यारी ने यह निष्कर्ष निकालने में गलती की थी कि ठाकरे ने विधायकों के बहुमत का समर्थन खो दिया था।
राज्यपाल के पास फ्लोर टेस्ट बुलाने के लिए कोई पुख्ता आधार नहीं था। इस मामले में राज्यपाल के विवेक का प्रयोग कानून के अनुसार नहीं था।
सदन के स्पीकर का शिंदे गुट की ओर से प्रस्तावित स्पीकर गोगावले को चीफ व्हिप नियुक्त करना अवैध फैसला था। स्पीकर को सिर्फ राजनीतिक दल की ओर से नियुक्त व्हिप को ही मान्यता देनी चाहिए थी।

उद्धव ठाकरे ने कहा कि महाराष्ट्र में कोई सरकार नहीं है। आज इस सरकार में नैतिकता नहीं है। जैसे मैंने नैतिकता के आधार पर इस्तीफा दिया, वैसे ही इस मुख्यमंत्री को इस्तीफा देना चाहिए। जिनको पार्टी ने सबकुछ दिया, उन्होंने गद्दारी की। मैं गद्दार लोगों के साथ सरकार कैसे चलाता।
उद्धव ठाकरे के वकील अभिषेक मनु सिंघवी ने कहा कि राज्यपाल का निर्णय गलत है। उन्होंने ऐसे तथ्य देखे जो वहां थे ही नहीं। आज सबसे महत्वपूर्ण निष्कर्ष यह है कि स्पीकर को तुरंत फैसला लेना चाहिए था। जब व्हिप का उल्लंघन हुआ तो राज्यपाल को खुद ही बागी विधायकों को डिस्क्वॉलिफाई करना चाहिए था। व्हिप किसी पॉलिटिकल पार्टी का होता है, सरकार का नहीं। ये सही बात है कि मुख्यमंत्री ने फ्लोर टेस्ट के पहले इस्तीफा न दिया होता तो सरकार बच सकती थी, लेकिन इससे राज्यपाल की भूमिका बड़ी हो जाती है। इस लिहाज से देखें तो आज संविधानिक बेंच ने दो बड़े फैसले दिए हैं।
