प्रयागराज। ज्ञानवापी के ASI सर्वे मामले में हाईकोर्ट में गुरुवार को सुनवाई हुई। दोनों पक्षों की दलील सुनने के बाद कोर्ट ने फैसला सुरक्षित रख लिया है। अब 3 अगस्त को कोर्ट फैसला सुनाएगी। मसाजिद इंतजामिया कमेटी ने हाईकोर्ट में सर्वे पर रोक लगाने की याचिका दायर की थी।
सरकार की तरफ से कोर्ट को जानकारी दी गई कि मंदिर सीआईएसएफ की सुरक्षा में है। कोर्ट ने हिंदू पक्ष से सवाल पूछा कि वाद तय करने में देरी क्यों हो रही है। हिंदू पक्ष के वकील विष्णु शंकर जैन ने कोर्ट कार्यवाही की जानकारी दी।
वहीं मुस्लिम पक्ष के वकील एसएफए नकवी ने कोर्ट से कहा,1947 से भवन की यही स्थिति है, जिसमें बदलाव नहीं किया जा सकता। प्लेस आफ वर्शिप एक्ट की धारा 3 कहती है कि कोई व्यक्ति पूजा स्थल की प्रकृति में बदलाव नहीं कर सकेगा।
इससे पहले बुधवार को हाईकोर्ट ने दोनों पक्षों को सुना था। ASI के अपर निदेशक ने हलफनामा जारी किया। बताया कि सर्वे से भवन को कोई नुकसान नहीं होगा। न ही कोई निर्माण हटाया जाएगा। इसके बाद सर्वे पर लगी रोक गुरुवार शाम पांच बजे तक बढ़ा दी गई। चीफ जस्टिस प्रीतिंकर दिवाकर की खंडपीठ में सुनवाई हुई।

सवाल: चीफ जस्टिस ने पूछा, एएसआई की कानूनी पहचान क्या है? यह कब अस्तित्व में आया और किस उद्देश्य से लाया गया?
जवाब: असिस्टेंट सॉलिसिटर जनरल ऑफ इंडिया ने बताया कि एएसआई 100 साल से अधिक पुरानी संस्था है।
एएसआई अधिकारी ने भी जवाब दिया कि ASI स्मारकों और पुरावशेषों की सुरक्षा और उनके संरक्षण का काम करता है। इसका मुख्य उद्देश्य देश के भीतर स्मारकों की रक्षा करना है।
सवाल: – चीफ जस्टिस ने पूछा, क्या ड्रिलिंग को अधिनियम में परिभाषित किया गया है?
जवाब: एएसआई एक्सपर्ट नहीं।
सवाल: कोर्ट ने एसएसआई से पूछा की क्या, बिना नुकसान पहुंचाए सर्वे किया जा सकता है।
जवाब: एसएसआई ने कहा, हम ब्रश के जरिए सर्वे करेंगे। इससे ज्ञानवापी को कोई नुकसान नहीं पहुंचेगा। एएसआई के पास इंस्ट्रूमेंट है, जांच कर सकती है। विशेषज्ञ इंजीनियर हमारे पास है।
राम मंदिर केस में भी ऐसा किया गया।
सवाल: कोर्ट ने कहा- आप सभी ने बहस की लेकिन एप्लीकेशन क्या है और किस ग्राउंड पर दी गई, यह किसी ने नहीं बताया। कृप्या अपलिकेशन पढ़िए।

वहीं विष्णु शंकर जैन ने कोर्ट में कहा, भवन के भीतर मंदिर के अवशेष हैं। हमारे पास इसके साक्ष्य मौजूद हैं। एएसआई जांच कर पता कर सकती है। औरंगजेब ने मंदिर तोड़ा, निर्माण नहीं किया। मुस्लिम ने मंदिर की दीवार पर मस्जिद का रूप दिया। विष्णु शंकर जैन ने टैबलेट से चीफ जस्टिस को फोटोग्राफ भी दिखाया। जैन ने कहा, ज्ञानवापी परिसर के अंदर, संस्कृत श्लोक, पुराने ज्योतिर्लिंग, हिंदू कलाकृतियाँ आदि मौजूद हैं। हमारे आवेदन के साथ पश्चिमी दीवार की एक तस्वीर है। हम बैरिकेडिंग एरिया का सर्वे चाहते हैं।
ASI के अपर निदेशक ने कहा- अनुमति मिली तो 31 तक हो जाएगा सर्वे
इलाहाबाद हाईकोर्ट में मसाजिद कमेटी ने वाराणसी जिला जज के ASI सर्वे कराने के आदेश के खिलाफ याचिका दाखिल की है। बुधवार को हाईकोर्ट ने ASI सर्वे तकनीक के बारे में गहनता से पड़ताल की। कोर्ट में मौजूद अपर महानिदेशक पुरातत्व विभाग आलोक त्रिपाठी ने कहा कि वैज्ञानिक सर्वे से भवन को कोई नुकसान नहीं होगा। न ही कोई निर्माण हटाया जाएगा।
आलोक ने बताया कि जीपीआर सिस्टम से जमीन के भीतर की जांच होगी। अन्य सिस्टम से दीवार खंभे आदि की जांच की जाएगी। इससे पहले पैमाइश और फोटोग्राफी की गई है। अगर सर्वे जारी रखने की अनुमति मिली तो एक हफ्ते यानी 31 जुलाई तक सर्वे पूरा कर लिया जाएगा।
