शिवसेना विधायक दल के नेता के तौर पर शिंदे का राज्यपाल के सामने दावा
एकनाथ शिंदे समेत शिवसेना के 16 बागी विधायकों की सदस्यता का मामला सुप्रीम कोर्ट में है। कोर्ट ने बागी विधायकों को 12 जुलाई तक जवाब देने के लिए अंतरिम राहत दी थी। मामले की अगली सुनवाई 11 जुलाई को होनी है, जिसमें महाराष्ट्र पुलिस, डिप्टी स्पीकर, केंद्र सरकार और शिवसेना से जवाब मांगा गया है।
दिलचस्प बात यह है कि पहली सुनवाई में राज्यपाल पार्टी नहीं थे, लेकिन बुधवार को हुई देर रात सुनवाई में सुप्रीम कोर्ट ने राज्यपाल के प्रमुख सचिव को भी नोटिस जारी करके जवाब मांगा है। इसके बाद गुरुवार को राज्यपाल ने शिंदे को सरकार बनाने का आमंत्रण देकर शिवसेना में उनके दावे को मजबूत कर दिया। ऐसे में कोर्ट में विचाराधीन केस में राज्यपाल द्वारा शिंदे को सीएम के तौर पर आमंत्रण से सरकार पर संकट बढ़ गया है।

उद्धव खेमे के चीफ व्हिप के अनुसार जिन विधायकों के खिलाफ अयोग्यता मामले की सुनवाई चल रही है, उनके विधानसभा की कार्यवाही में शामिल होने पर प्रतिबंध लगाया जाए। उनका यह भी तर्क है कि उद्धव ठाकरे को शिवसेना के संगठनात्मक चुनाव में अध्यक्ष चुना गया था, इसलिए वे ही असली शिवसेना है।
उनके वकील के अनुसार शिंदे गुट ने कोई विलय नहीं किया है, इसलिए उनकी वैधानिकता के बारे चुनाव आयोग ही फैसला कर सकता है। कोर्ट ने नई अर्जी पर 11 जुलाई को ही सुनवाई करने के लिए कहा, जिससे उनके वकील भड़क कर बोले कि-डेमोक्रेसी का डांस नहीं चल रहा । इस पर कोर्ट ने कहा कि वे आंख खोलकर बैठे हुए हैं और स्थिति पर उनकी नजर है।
नए स्पीकर का चुनाव और बहुमत परीक्षण दोनों संदेह के घेरे में
16 बागी विधायकों की सदस्यता रद्द करने और डिप्टी स्पीकर के खिलाफ अविश्वास प्रस्ताव का मामला सुप्रीम कोर्ट में है। एक अन्य मामले में महाराष्ट्र में स्पीकर पद पर विवाद सुप्रीम कोर्ट के सामने लंबित है। ऐसे में नए स्पीकर का चुनाव और सदन में बहुमत परीक्षण में बागी विधायकों को वोट देने पर न्यायिक विवाद की स्थिति बनी हुई है। अगर कोर्ट का फाइनल फैसला बागी विधायकों के पक्ष में नहीं आया, तो सरकार का पासा पलट सकता है।
लीगल और फैक्चुअल आधार पर हो सकता है कोर्ट का फैसला
स्पीकर और चुनाव आयोग को शिवसेना पर शिंदे और उद्धव गुट के दावे पर अपना फैसला जल्द लेना होगा। सभी पक्ष अपना जवाब और काउंटर जवाब फाइल करेंगे, उसके बाद ही सुप्रीम कोर्ट में फाइनल फैसला हो सकेगा। इस मामले में दो बड़े संवैधानिक पॉइंट पर सुप्रीम कोर्ट का फाइनल फैसला आएगा।
पहला, क्या दो तिहाई बागी विधायकों को दलबदल कानून के दायरे से बचने के लिए क्या अन्य दल के साथ विलय जरूरी है? दूसरा स्पीकर या डिप्टी स्पीकर के खिलाफ अविश्वास प्रस्ताव पारित होने पर बागी विधायकों की अयोग्यता का फैसला कब और कैसे होगा?
दिलचस्प बात यह है बागी विधायकों की संख्या के दम पर शिंदे सीएम बने हैं और नए स्पीकर के चुनाव में भी उनके वोट काउंट होंगे, लेकिन आगे चलकर सुप्रीम कोर्ट के फाइनल फैसले के बाद विधायकों की सदस्यता में आंच आई तो फिर स्पीकर और मुख्यमंत्री दोनों की कुर्सी खतरे में पड़ सकती है।
भाजपा ने इसी वजह से तो शिंदे को नहीं बनाया मुख्यमंत्री?
2019 में जल्दबाजी की वजह से 82 घंटे के भीतर ही देवेंद्र फडणवीस को इस्तीफा देना पड़ा था। इसलिए इस बार भाजपा कोई रिस्क नहीं लेना चाहती थी। भाजपा आलाकमान ने एकनाथ शिंदे को मुख्यमंत्री बनाने का ऐलान करके सबको चौंका दिया।
इस चौंकाने वाले फैसले के पीछे राजनीतिक के साथ-साथ कानूनी वजह भी है। दरअसल, नई सरकार का सारा दारोमदार सुप्रीम कोर्ट के आखिरी फैसले पर टिका है। शिंदे को शिवसेना के विधायकों ने सर्वसम्मति से नेता चुना था। सरकार बनाने के बाद उनके पास कुछ और विधायक आ सकते हैं।
शिवसेना के विधायक के तौर पर मुख्यमंत्री के बहुमत परीक्षण में शिंदे अपने चीफ व्हिप को मान्यता दिलवाएंगे। व्हिप के उल्लंघन पर उद्धव ठाकरे गुट के शिवसेना के विधायकों के ऊपर दलबदल कानून की तलवार लटक सकती है। उद्धव के एमएलसी पद से इस्तीफे के बाद सदन में शिंदे की राह आसान हो गई है, लेकिन सुप्रीम कोर्ट का आखिरी फैसला आने तक शिंदे सरकार के ऊपर खतरे की तलवार लटकती रहेगी।
