सुप्रीम कोर्ट ने गुरुवार को एक मामले की सुनवाई के दौरान यह कहा कि पिता को बेटे का खर्च सिर्फ 18 साल की उम्र यानी व्यस्क होने तक नहीं बल्कि उसके पहली डिग्री पाने तक उठाना होगा।
नई दिल्ली। सुप्रीम कोर्ट ने गुरुवार को एक मामले की सुनवाई के दौरान यह कहा कि पिता को बेटे का खर्च सिर्फ 18 साल की उम्र यानी व्यस्क होने तक नहीं बल्कि उसके पहली डिग्री पाने तक उठाना होगा। सुप्रीम कोर्ट ने यह भी कहा कि ग्रैजुएशन को अब बेसिक शिक्षा माना जाता है।
जस्टिस धनंजय वाई चंद्रचूड़ और एमआर शाह ने एक शख्स को निर्देश दिया कि वह 31 मार्च 2027 तक अपने बेटे की शिक्षा का खर्च उठाए। कोर्ट ने कहा कि बच्चे को अपना स्नातक पूरा करने तक आर्थिक सहयोग की जरूरत है।
फैमिली कोर्ट के आदेश में थोड़ा बदलाव करते हुए कोर्ट ने शख्स को कहा, ‘आज के जमाने में जब कॉलेज पूरा कर लेने पर बेसिक डिग्री मिलती है ऐसे में बेटे को सिर्फ बालिग होने यानी 18 साल की उम्र तक पैसे देना काफी नहीं है। आपको उसकी पढ़ाई का खर्च कम से कम तब तक उठाना चाहिए जब तक वह कॉलेज की डिग्री नहीं ले लेता।’
फैमिली कोर्ट ने सितंबर 2017 में शख्स को हर महीने अपने बेटो को 20 हजार रुपये गुजारा-भत्ता देने का आदेश दिया था। शख्स ने 1999 में पहली शादी की थी। इस शादी से उन्हें एक बेटा है। अपनी पहली बीवी से इस शख्स ने साल 2005 में ही तलाक ले लिया था।
यह शख्स कर्नाटक सरकार के स्वास्थ्य विभाग का कर्मचारी है। साल 2005 में पत्नी से तलाक के बाद कर्नाटक की फैमिली कोर्ट ने उन्हें हर महीने अपने बेटे के लिए 20 हजार रुपये खर्चा देने का आदेश दिया ता। इस आदेश के खिलाफ शख्स ने हाई कोर्ट में अपील की। हाई कोर्ट ने भी फैमिली कोर्ट के आदेश को बरकरार रखा।
इसके बाद शख्स ने सुप्रीम कोर्ट में याचिका दायर कर कहा कि उसको हर महीने 21 हजार रुपये सैलरी मिलती है और चूंकि उसने दूसरी शादी की है, जिससे उसके दो बच्चे हैं, तो ऐसे में पहली शादी से हुए बेटे को हर माह 20 हजार रुपये देना उसके लिए मुश्किल है।
शख्स के वकील ने कोर्ट में यह भी दलील दी कि उसने अपनी पहली पत्नी से तलाक इसलिए लिया था क्योंकि वह किसी और के साथ संबंध में थी। हालांकि, कोर्ट ने इस दलील को तुरंत यह कहते हुए खारिज कर दिया कि इसके लिए बच्चे को सजा नहीं दी जा सकती। कोर्ट ने कहा कि बच्चे का इन सबसे क्या लेना-देना है और जब आपने दूसरी शादी की तो आपको पता होना चाहिए था कि आपका एक बेटा है जिसकी देखरेख आपको करनी है।
बच्चे और उसकी मां की ओर से कोर्ट में पेश हुए वकील गौरव अग्रवाल ने कहा कि बच्चे के पिता हर महीने कुछ कम राशि दें लेकिन वह बेटी की ग्रैजुएशन तक की पढ़ाई तक यह राशि देते रहें।
बेंच ने इस सुझाव को सही ठहराते हुए गुजारे-भत्ते की राशि को घटाकर 10 हजार रुपये प्रति माह कर दिया। कोर्ट ने यह भी कहा कि हर वित्त वर्ष में शख्स को यह राशि 1000 रुपये बढ़ानी होगी।
