मुंबई। ब्रिटेन की पेट्रोलियम कंपनी केयर्न एनर्जी (Cairn Energy) और भारत सरकार के बीच टैक्स विवाद गहराता जा रहा है। केयर्न एनर्जी ने अब भारत सरकार के खिलाफ कार्रवाई करना भी शुरू कर दिया है। लंदन के फाइनेंशियल टाइम्स के मुताबिक केयर्न एनर्जी ने पेरिस में भारत सरकार के ओनरशिप वाली 20 संपत्तियों को फ्रीज कर दिया है।
पेरिस में सरकार की 20 प्रॉपर्टी सीज
केयर्न की ये कार्रवाई इंटरनेशनल ट्रिब्यूनल द्वारा दिए गए आदेश के बाद की गई है, जिसमें कहा गया है कि भारत सरकार 1.7 बिलियन डॉलर (करीब 12,600 करोड़ रुपये) का भुगतान करेगी। कंपनी ने कहा कि वह 20 संपत्तियों के ओनरशिप को ट्रांसफर करेगी, जिनकी कीमत 20 मिलियन यूरो (176 करोड़ रुपये) से ज्यादा है। रिपोर्ट के मुताबिक उसने फ्रांस की एक अदालत ने संपत्ति फ्रीज करने की मंजूरी दी है।
न्यूज एजेंसी PTI के मुताबिक, 11 जून को एक फ्रांस की अदालत ने केयर्न एनर्जी को भारत सरकार की संपत्तियों का अधिग्रहण करने का आदेश दिया, जिसके बाद फ्रीज करने की कानूनी प्रक्रिया बुधवार शाम को पूरी हो गई है। केयर्न एनर्जी ने मई में एयर इंडिया पर मध्यस्थता लागू करने के लिए मुकदमा दायर किया था, जिसे उसने भारत के खिलाफ टैक्स विवाद में जीता था।

ऑयल ग्रुप का कहना है कि, फ्रांस की अदालत ट्रिब्यूनल ज्यूडिशियरी डी पेरिस ( Judiciaire de Paris) ने संपत्ति फ्रीज को मंजूरी दी है। संपत्तियों की ओनरशिप लेने के लिए एक आवश्यक कदम था।

केयर्न 21 दिसंबर के अंतरराष्ट्रीय मध्यस्थता न्यायाधिकरण के फैसले को लेकर भारत के खिलाफ अमेरिका, ब्रिटेन, नीदरलैंड, कनाडा, फ्रांस, सिंगापुर और क्यूबेक की अदालतों में पहले ही अपील दायर कर चुकी है। इससे उसके लिए भारत सरकार की विदेशी संपत्तियों को सीज करना और मध्यस्थता न्यायाधिकरण द्वारा तय रकम की वसूली करना आसान हो सकता है।
रेट्रोस्पेक्टिव टैक्स मामले में अंतरराष्ट्रीय मध्यस्थता न्यायाधिकरण ने केयर्न के पक्ष में फैसला सुनाया था और भारत सरकार को केयर्न को भुगतान करने को कहा था। यह फैसला दिसंबर 2020 में आया था। एक तरफ भारत सरकार ने मध्यस्थता न्यायाधिकरण के फैसले को अंतरराष्ट्रीय कोर्ट में चुनौती दी है, वहीं दूसरी तरफ केयर्न एनर्जी ने विदेशों में भारत सरकार की संपत्ति की पहचान करना शुरू कर दिया है। इनमें सरकारी बैंकों के विदेशी अकाउंट्स भी शामिल हैं। अगर केयर्न और भारत सरकार के बीच सेटलमेंट नहीं हुआ तो कंपनी इन अकाउंट्स को सीज कर सकती है।
