बीछवाल थाना क्षेत्र की नाबालिग पीड़िता को 6 साल बाद बीकानेर के विशिष्ट सेशन न्यायालय(पोक्सो) से न्याय मिला है जिसका फैसला 17 दिसंबर को आया है। पीड़िता की हंसमुख जिंदगी को नरक बनाने वाले बलात्कारी सिराजू उर्फ अब्दुल निवासी पश्चिम बंगाल को न्यायालय ने 10 साल का कठोर कारावास व 20 हजार अर्थदंड और इस सजा के साथ 6 साल की सश्रम कारावास व 10 हजार के अर्थदंड से दंडित किया है । अर्थदंड जमा नही करवाने पर आरोपी को 6 माह का अतिरिक्त कारावास भी भुगतना होगा । मामला वर्ष 2015 में बीछवाल थाना क्षेत्र का है ।
पीड़िता को न्याय दिलाने में अहम भूमिका निभाने वाले व इस केस की पैरवी करने वाले एडवोकेट जयदीप कुमार शर्मा ने बताया कि वर्ष 2015 में पीड़िता की मां ने बीछवाल थाने में गुमशुदगी की रिपोर्ट देते हुए परिवाद दिया कि उसकी नाबालिग बेटी को कोई अज्ञात उठा ले गया जिस पर पुलिस ने इस मामले में तेजी दिखाते हुए लडक़ी को बरामद कर पश्चिम बंगाल निवासी आरोपी सिराजू उर्फ अब्दुल मुसलमान को दबोचकर काल कोठरी का रास्ता दिखाया । पीड़िता ने पुलिस को दिए पर्चा बयान पर बताया कि आरोपी उसे जबरदस्ती उठाकर ले गया जंहा उसे बंधक बनाकर रखा इस दौरान आरोपी उससे रोजाना जबरदस्ती बलात्कार किया करता था। पुलिस ने आरोपी के खिलाफ आईपीसी की विभिन्न धाराओं में मुकदमा दर्ज कर जांच शुरू की । चूंकि पीड़िता नाबालिग थी ऐसे में इस केस में पॉक्सो एक्ट के तहत कानूनी कार्रवाई शुरू की गई ।
एडवोकेट शर्मा ने बताया इस केस को उन्होंने हाथ मे लेते हुए एक ही ध्येय रखा कि जल्द से जल्द पीड़िता को न्यायालय से इंसाफ दिलाया जाए ताकि समाज में इंसान के रूप में ऐसे बलात्कारी भेड़ियों को उनकी असलियत दिखा सके जो यह मन मे ख्याल पाले रहते है कि मामला कोर्ट में चल रहा है,तो फैसला आने में बीसों साल लग जाएंगे या नही तो रसूख व पैसों के दम पर वे केस जीत लेंगे । इन्ही विचारों का गला घोंटने के लिए उन्होंने इस केस को मजबूती से लड़ा कोर्ट के समक्ष सच्चाई के साथ सबूत रखे । गवाहों के बयान करवाए । जिस पर न्यायालय ने पीड़िता के पक्ष में ऐतिहासिक फैसला सुनाते हुए पश्चिम बंगाल निवासी आरोपी सिराजू उर्फ अब्दुल मुसलमान को दोषी मानते हुए भादसं 376 (2) (एन) के तहत सश्रम 10 वर्ष के कठोर कारावास एवं बीस हजार रूपये अर्थदण्ड से दण्डित किया गया व धारा 366 के तहत सश्रम 6 वर्ष के कारावास एवं दस हजार रूपये के अर्थदण्ड की सजा सुनाई । दोनो सजाएं साथ साथ चलेगी व अर्थदण्ड की अदायगी नही करने पर 6 माह का अतिरिक्त कठोर कारावास का फैसला न्यायालय ने सुनाया है।
