Bike Taxi Ban In Delhi: दिल्ली में रैपिडो, उबर जैसी बाइक टैक्सी पर लगी रोक मामले में सोमवार को सुप्रीम कोर्ट में सुनवाई हुई। इस सुनवाई में सुप्रीम कोर्ट ने दिल्ली हाई कोर्ट के आदेश पर रोक लगा दिया। इसका मतलब है कि दिल्ली में बाइक टैक्सी पर लगी रोक जारी रहेगी।
नई दिल्ली। दिल्ली में बाइक-टैक्सी पर रोक जारी रहेगी। सोमवार को सुप्रीम कोर्ट ने हाई कोर्ट के आदेश पर रोक लगाते हुए यह फैसला दिया। रैपिडो, उबर जैसी कंपनियों की बाइक टैक्सी सर्विस को बिना लाइसेंस नहीं चलाए जाने का फैसला सरकार ने दिया था। जिसके बाद इन कंपनियों ने हाईकोर्ट का दरवाजा खटखटाया था। हाई कोर्ट ने इस मामले में सरकार को कारण बताओ नोटिस जारी किया था। जिसमें सरकार ने कहा था कि सरकार टू वीलर वाहन के बाइक टैक्सी के रूप में इस्तेमाल के लिए नीति बना रही है। नीति बनाए जाने तक इस पर रोक लगी रहेगी। हाई कोर्ट से यह मामला सुप्रीम कोर्ट पहुंचा। जहां सोमवार को सुप्रीम कोर्ट ने हाई कोर्ट के स्टे ऑर्डर को रद्द करते हुए कहा नीति बनाए जाने तक दिल्ली में बाइक टैक्सी पर रोक बरकरार रहेगी।
हाई कोर्ट को तेजी से मामला सुनवाई को कहा
सोमवार को सुनवाई में सुप्रीम कोर्ट ने हाई कोर्ट से तेजी के साथ मामला सुनने को कहा है। दोनों पक्षों को जल्द सुनवाई की अप्लिकेशन दायर करने की छूट दी गई है। मालूम हो कि दिल्ली सरकार ने हाई कोर्ट के फैसले के खिलाफ सर्वोच्च अदालत में अपील दायर की थी। दूसरी ओर बाइक-टैक्सी एग्रीगेटर्स की मांग थी कि जब तक दिल्ली सरकार नीति नहीं बनाती, तब तक उन्हें बिना लाइसेंस ऑपरेट करने दिया जाए।
19 फरवरी को सरकार ने जारी किया था आदेश
बताते चले कि 19 फरवरी 2023 को दिल्ली सरकार ने एक पब्लिक नोटिस जारी किया था। इसके जरिए दिल्ली में बाइक टैक्सी पर रोक लगा दी गई थी। रैपिडो और उबर ने इसके खिलाफ हाई कोर्ट में याचिका डाली। हाई कोर्ट ने 21 फरवरी को कारण बताओ नोटिस जारी किया। जिस पर दिल्ली सरकार ने कहा था कि एग्रीगेटर्स की तरफ से दोपहिया वाहनों का इस्तेमाल बिना प्रॉपर लाइसेंस और परमिट के हो रहा है।
बिना पॉलिसी लाए बाइक टैक्सी का इस्तेमाल गलत
सरकार ने कोर्ट को कहा था कि एग्रीगेटर के लिए लाइसेंस की जरूरत का प्रावधान मोटर वीइकल एक्ट की धारा 93 में है। दिल्ली सरकार की दलील थी कि ये गाइडलाइंस चार पहिया और दो पहिया, दोनों तरह के वाहनों के लिए है। ऐसे में बिना पॉलिसी लाए नॉन ट्रांसपोर्ट टी-वीलर्स का यूज एग्रीगेटर्स नहीं कर सकते। सरकार ने यह कहा था कि वो एक पॉलिसी बना रही है। जब तक यह लागू नहीं होती, टू वीलर वाहन के बाइक टैक्सी के रूप में इस्तेमाल पर रोक जारी रहेगी।

दूसरी ओर रैपिडो और उबर का कहना था कि दिल्ली सरकार के फैसले पर रोक लगाना हाई कोर्ट के अधिकार क्षेत्र में है। दूसरी दलील थी कि हजारों राइडर्स ऐसी बाइक टैक्सी चलाते हैं और बैन से उनकी आजीविका पर असर पड़ेगा। जिन प्राइवेट दोपहिया वाहनों को कॉमर्शियल/ट्रांसपोर्ट वाहन के रूप में जोड़ा गया है, उन्हें नीति बनने और लाइसेंस मिलने तक यात्री ढोने दिया जाए। सुनवाई के दौरान केंद्र ने कहा कि एग्रीगेटर्स के तहत टू वीलर्स ऑपरेट करने के लिए लाइसेंस जरूरी है। अब देखना है कि दिल्ली सरकार टू वीलर के लिए कब तक नीति बनाती है।
