दिल्ली हाईकोर्ट ने गणतंत्र दिवस पर किसानों की ट्रैक्टर परेड के दौरान हुई हिंसा और सुरक्षा में कथित चूक की जांच की मांग करने वाली याचिका पर सुनवाई से गुरुवार को इनकार कर दिया। हाईकोर्ट के मुख्य न्यायाधीश डीएन पटेल और न्यायमूर्ति ज्योति सिंह की पीठ ने याचिकाकर्ता से पूछा कि आप याचिका वापस लेंगे या वह जुर्माना लगाकर इसे खारिज करें।
नई दिल्ली। दिल्ली हाईकोर्ट ने गणतंत्र दिवस पर किसानों की ट्रैक्टर परेड के दौरान हुई हिंसा और सुरक्षा में कथित चूक की जांच की मांग करने वाली याचिका पर सुनवाई से गुरुवार को इनकार कर दिया। हाईकोर्ट के मुख्य न्यायाधीश डीएन पटेल और न्यायमूर्ति ज्योति सिंह की पीठ ने याचिकाकर्ता से पूछा कि आप याचिका वापस लेंगे या वह जुर्माना लगाकर इसे खारिज करें। बता दें कि 26 जनवरी को ट्रैक्टर परेड के दौरान दिल्ली में आईटीओ और लाल किला समेत कई जगहों पर हिंसा हुई थी।
अदालत ने याचिकाकर्ता एंव वकील विवेक नारायण शर्मा से पूछा कि क्या उन्होंने 26 जनवरी की घटना के ठीक बाद ही याचिका लिखनी शुरू कर दी थी क्योंकि इसे 29 जनवरी को दायर किया गया है। पीठ ने वकील से पूछा, ‘आपने 26 जनवरी दोपहर को ही याचिका लिखनी शुरू कर दी थी? क्या आपको पता है कि दण्ड प्रक्रिया संहिता के तहत जांच करने के लिए कितना समय दिया गया है? आप एक वकील हैं। बताएं जांच के लिए कितना समय दिया गया है?’
उसने कहा, ‘आप चाहते हैं कि घटना के दो दिन के भीतर ही जांच पूरी हो जाए? क्या सरकार के पास कोई जादू की छड़ी है, जिसे घुमाते ही सब कुछ हो जाएगा? हम दंड लगाकर इसे खारिज करें या आप इसे वापस ले रहे हैं?’ इसके बाद शर्मा ने कहा कि वह उत्तर प्रदेश के तीन निवासियों की ओर से दायर की गई याचिका को वापस ले लेंगे। याचिका में हिंसा में शामिल लोगों के खिलाफ कार्रवाई की मांग की गई थी।
पीठ ने कहा, ‘अनुमति दी जाती है। याचिका अब खारिज हो गई है क्योंकि उसे वापस ले लिया गया है।’ सॉलिसिटर जनरल (एसजी) तुषार मेहता ने सुनवाई के दौरान अदालत को बताया था कि हिंसा के संबंध में 43 प्राथमिकी दर्ज की गई हैं और इनमें से 13 दिल्ली पुलिस के विशेष प्रकोष्ठ (अपराध शाखा) को स्थानांतरित कर दी गई है।
गौरतलब है कि केन्द्र के तीन नए कृषि कानूनों के खिलाफ किसान दिल्ली से लगी सीमाओं पर दो महीने से अधिक समय से प्रदर्शन कर रहे हैं। 26 जनवरी के दिन किसानों की ट्रैक्टर परेड के दौरान हिंसा हो गई थी और लाल किले पर धार्मिक झंडा भी लगा दिया गया था। बता दें कि कृषि कानूनों के खिलाफ 26 नवंबर से ही पंजाब, हरियाणा, उत्तर प्रदेश समेत देशभर के कई हिस्सों से आए किसान दिल्ली की सीमाओं पर प्रदर्शन कर रहे हैं।
